Terms and Conditions

Payments:

• A 60% non-refundable Fixed Booking Deposit is payable 2 weeks in advance to confirm

your order and allow us to ensure that the stock for your order is available.

Our company operates on a strict payment policy and all invoices need to be paid in full before any work can commence a day before the event and does not accept 30-day payment terms. Payment for goods and services rendered is due upon receipt of invoice unless otherwise agreed upon in writing.
Payment Schedule: Clients are required to adhere to the payment schedule outlined in the invoice. We do not entertain requests for extended payment periods beyond what is specified in our payment terms.
Dispute Resolution: In the event of any disputes regarding invoices or payment terms, clients are encouraged to contact our accounts department to resolve the issue promptly. However, failure to make payment in accordance with our terms may result in escalation of the matter to legal proceedings.

• In cases where the function is in the same week then the booking the full payment is

required immediately on receipt of invoice.

• For décor requirement in less than 48hr we need the immediate proof of payment for

the full amount.

• We do not accept payments with cheque. Payment options accepted by "Alfie Balloons" EFT, Card or Cash.

• No Discount on delivery cost and / or labour charges & cancellations.

• If you wish to make changes to your order, please notify "Alfie Balloons" of these

changes no later than one (1) week before your event. All changes must be in writing

via e-mail, or over a Messaging platform. Any changes after this period may result in

extra cost due to the purchase(s) of products for the event, and will be subject to

availability.

• If you have requested outdoor decor "Alfie Balloons" cannot be held accountable for

weather conditions and you will still be liable for the total job cost. The "Alfie Balloons"

team will of course do their best to suggest alternative solutions.

• If you cancel a decor job or bouquet delivery order 48 hours before event date, you

will be liable for the total job cost.

Amendments: These Payment terms and conditions are binding and may not be modified or amended except in writing and signed by authorised representatives of both parties.Décor Products:

While we strive for precision in presenting the colors, features, specifications, and nuances of our décor products, we cannot ensure absolute accuracy, completeness, reliability, currency, or freedom from errors. Electronic displays may not faithfully replicate the true colors and details of the products. Availability of décor items is contingent upon stock, and we cannot guarantee their availability post-order placement. In cases of unavailability, we will offer alternative solutions and notify you promptly via email, WhatsApp, or phone. We retain the right to discontinue any product at our discretion, without prior notice, for any reason.

Important information:

To provide you with the best possible service it is important to ensure that all requirements

are met prior to "Alfie Balloons" team arriving to set up for your event. These requirements

not being met impact on the time needed to complete your request, and can create a

ripple effect on any other orders we might have for that day. These requirements are:

• Access to the venue on the agreed time.

• The room must already be laid out (we cannot be responsible for moving tables &

chairs, unless otherwise agreed)

• The "Alfie Balloons" team cannot be held responsible for any damages to any of the

decor once we have completed our work, and therefore it would be advisable to

ensure that the room is adequately secured once we have left.

• For us to work as effective & fast as possible, we request that the "Alfie Balloons" team

be allowed to work without too many observers or people moving around.

In warm weather, Latex Balloons will typically only last outside for a day. Sun, Wind and

heat will biodegrade the latex.

Helium does not work well outdoors in the heat. (Like all substances, helium molecules,

which are less dense than air to begin with, expand when heated. This expansion of

molecules causes helium to be even less dense. Steadily increased heat and pressure

from the moving molecules will eventually lead to the balloon popping.)

Helium filled balloons normally float for a maximum of 8 hours in good weather conditions

or indoors.

While Hi-Float can be used to make, balloons float longer, it is not generally meant for

outside use. If you want your balloons to float longer outside, you should plan on doing

daily touch-up work to your balloon arrangements.

Hired Items & Equipment:

• When items are hired a refundable security, deposit will be required and held until the

safe return of the hired item(s). If products are not returned by the agreed deadline or

are returned damaged the deposit will be kept by "Alfie Balloons team as payment

to repair / replace such items.

• A replacement cost will be added for any damage or loss to any of the equipment

used by Alfie Balloons for any of our decor installations. For example, any stands or

poles.

By making the payment or sending us a purchase order number for your invoice you indicate that you have read and accept above stated Terms and Conditions for Alfie Balloons décor services.

ABOUT OUR ONLINE SHOP

Our online shop is a facility supported by Alfie Balloons (Pty.) Ltd. which is an business in the Balloon Industry that enables you to purchase balloon designs on our online shop, and have it delivered to you to at the address specified by you during the purchasing process. Our online shop website manages the entire online shopping process, from making the balloon designs available in the right place and at the right price, to a smooth and secure checkout process. If we don’t have an item on our site, it may be because our suppliers are out of stock and you are welcome to notify us as such and we will try our best to procure such items for you.

USE OF SITE

You may only use this site to browse the content, make legitimate purchases and shall not use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent purchase. Alfie Balloons (Pty.) Ltd cannot be held liable for misuse of any balloon designs purchased on this site. This site and the content provided in this site may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed. Deep-linking, embedding or using analogous technology is strictly prohibited. Unauthorized use of this site and/or the materials contained on this site may violate applicable copyright, trademark or other intellectual property laws or other laws.

OUR RIGHTS

We may:

Modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
Change these Conditions from time to time, and your continued use of the Website (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions, then you must immediately stop using the Website.

We will use our reasonable endeavours to maintain the Website. The Website is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website due to circumstances beyond our control.

DELIVERY POLICY

When you click to make a purchase with us legal obligations arise and your right to a refund of monies charged to your credit card or paid in any other way agreed by us, is limited by our terms & conditions. You must not make any purchase through this site unless you understand and agree to all our terms and conditions.

Once payment is made for the purchase, it is deemed that you have read and understood the terms and conditions for such purchase.

If you have any queries, please contact us before making any purchase for any product or service through this website.

We are not responsible for delayed deliveries caused by suppliers or any delays caused by any problems which may arise due to the sourcing of goods. If delivery is made and you are not available at the address and/or your phone number is not working – resulting in the delivery being returned to us – the customer will be liable for delivery costs due to non-availability and may be required to collect the order from the Alfie Balloons specified physical address. All risk in and to all goods shall pass to you on delivery thereof. You hereby confirm that the goods on the tax invoice issued duly represent the goods and services ordered by you at the prices agreed to by you and where delivery will take place that goods will be inspected and that you will ensure that these conform in all respects to the quality and quantity ordered and are free from any defects.

Any delivery note (copy or original) signed by you or your authorised representative shall be prima facie proof that delivery was made to you. We will be entitled to split the delivery of the goods ordered in the quantities and on the dates, we decide with your prior consent, which consent shall not be unreasonably withheld. In the event that you choose to engage your own third party to transport the goods, you indemnify us against any claims of any nature whatsoever that may arise from such an agreement. We will be entitled to engage a third party on our behalf to transport all goods purchased by you to the delivery address stipulated by you. We cannot guarantee that the goods will be dispatched or delivered on any particular date and time, you will have no claim against us in respect of any loss occasioned by any reasonable delay in dispatch or delivery of any goods ordered, nor may you cancel any order by reason of such reasonable delay.

OWNERSHIP AND RISK

Ownership in all goods sold and delivered shall remain vested in Alfie Balloons until the full purchase price has been paid.

WARRANTIES AND INDEMNITY

We make every effort to display as accurately as possible the colours, features, specifications, and details of the décor balloon designs available. However, we do not guarantee that the colours, features, specifications, and details of the décor balloon designs will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the décor balloon designs. The goods supplied can be used inside or outside a building, and we can’t be held accountable for any damages that occur the goods after goods was delivered or collected by you. Any such statements made shall not give rise to any liability or whatsoever nature on our part, our employees, subcontractors or subsidiaries. We will not be liable to you for any loss, damage or expense of any nature, whether direct, special, indirect or consequential, including but not limited to loss of health arising out of our distribution’s performance or your use of the goods. You indemnify and hold us (including our employees or subcontractors) harmless against all claims of whatsoever nature that may be brought or threatened against us by any third party arising from or in connection with any defect, latent or otherwise in any of the goods supplied by us.

ONLINE SHOP PAYMENT OPTIONS

All transactions will be processed in South African Rand (ZAR). Payment may be made via Visa and MasterCard. We also accept Bank Transfers/EFT (Electronic Funs Transfer) via the website.

CARD ACQUIRING AND SECURITY

We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the Website).

LAW

The Conditions will be exclusively governed by and construed in accordance with the laws of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

PRICING

Except where noted otherwise, the List Price displayed for balloon designs on our website represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The List Price is a comparative price estimate and may or may not represent the prevailing price in our physical facility or for other providers of the same product in every area on any particular day. For certain items that are offered as a set, the List Price may represent “open-stock” prices, which means the aggregate of the manufacturer’s estimated or suggested retail price for each of the items included in the set.

Alfie Balloons reserves the right to change its prices and pricing structure at any time and without notice. These prices however will always be displayed and visible before purchase.

Despite our best efforts, a small number of the items in our catalog may be mispriced. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before delivery or cancel your order and notify you of such cancellation.

Please note that this policy applies only to balloon designs sold and delivered through our online shop. Your purchases are charged at the time you place your order.

Due to the popularity of some balloon designs or services, our suppliers may not always have balloon designs or service ordered by you in stock. If the balloon designs and services ordered by you are not available or only a portion is available, you may cancel the order, or re-order the quantity that is available. Once the balloon designs or services become available, it will be delivered to you.

We reserve the right to cancel an order at any time.
